6.1 Prohibited Content: Illegal, Harmful or Abusive Submissions
You are strictly prohibited from submitting, uploading, generating, describing, or otherwise providing to our website, platform, or any MIBOOKO services (including story-creation tools, image or text inputs, feedback channels, or communication interfaces) any content that is unlawful, harmful, abusive, or otherwise inappropriate. This includes, without limitation:
a) any form of sexual, pornographic, or sexually explicit material, including content involving minors;
b) violent, graphic, hateful, extremist, terrorist, or radicalization-related material;
c) threats, harassment, incitement to violence, or discriminatory content;
d) any material that violates criminal law, child-protection law, or intellectual-property rights;
e) attempts to test, provoke, or “stress-test” the system by intentionally submitting illegal or harmful content, even as a joke.
Submitting such content may result in immediate suspension of access, deletion of your account, reporting to law-enforcement authorities, and pursuit of any civil or criminal remedies available under applicable law.
You acknowledge that providing illegal or harmful inputs—whether text, images, descriptions, or any other data—may cause direct and significant damage to MIBOOKO’s business, reputation, and operational integrity, and you agree to bear full responsibility for any resulting consequences.
7. Registration
You may register for an account with our website. During this process, you may be required to choose a password. You are responsible for maintaining the confidentiality of passwords and account information and agree not to share your passwords, account information, or secured access to our website or services with any other person. You must not allow any other person to use your account to access the website because you are responsible for all activities that occur through the use of your passwords or accounts. You must notify us immediately if you become aware of any disclosure of your password.
After account termination, you will not attempt to register a new account without our permission.
8. Idea submission
Do not submit any ideas, inventions, works of authorship, or other information that can be considered your own intellectual property that you would like to present to us unless we have first signed an agreement regarding the intellectual property or a non-disclosure agreement. If you disclose it to us absent such written agreement, you grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media.
9. Termination of use
We may, in our sole discretion, at any time modify or discontinue access to, temporarily or permanently, the website or any Service thereon. You agree that we will not be liable to you or any third party for any such modification, suspension or discontinuance of your access to, or use of, the website or any content that you may have shared on the website. You will not be entitled to any compensation or other payment, even if certain features, settings, and/or any Content you have contributed or have come to rely on, are permanently lost. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our website.
10. Returns, Refunds, Right of Withdrawal, and the 100% Smile Guarantee
10.1 Personalized Products
All MIBOOKO products are created individually based on the information provided by the customer during the ordering process. Each product is considered a personalized product made to the customer’s specifications.
The right of withdrawal does not apply to the following products:
a) personalized digital books (PDF and e-book formats);
b) personalized audiobooks;
c) personalized printed books (softcover and hardcover).
This exclusion applies in accordance with applicable consumer protection laws concerning goods made to order, clearly personalized products, and digital content delivered immediately after purchase.
10.2 Digital Content Delivery
By placing an order for digital content, the customer expressly agrees that:
a) the digital content generation process begins after purchase and the final personalized files are usually delivered within about 60 to 120 minutes;
b) the performance of the service begins before the expiry of the statutory withdrawal period;
c) the right of withdrawal is lost once the digital content has been delivered.
10.3 Refund Policy
Except as expressly stated in Section 10.6 (100% Smile Guarantee for Digital eBooks) below, and except where mandatory law provides otherwise, refunds are not available once:
a) the digital content has been delivered; or
b) the production of a personalized printed book has commenced.
For the avoidance of doubt:
This does not affect the customer’s entitlement to correction, replacement, or technical assistance for defects or delivery issues under Section 10.5, or any statutory consumer rights that cannot be excluded.
This standard rule applies in particular to personalized audiobooks and printed books (softcover/hardcover).
10.4 AI-Assisted Creation and Quality Standards
MIBOOKO products are created using a combination of advanced artificial intelligence systems, proprietary generation processes, and human quality controls. Each product is individually generated using MIBOOKO’s guided story frameworks, generation rules, and quality guardrails. These systems are shaped through consultation and internal quality standards; however, individual books are not manually reviewed one by one before delivery unless explicitly stated otherwise.
Due to the nature of AI-assisted creative production, minor technical, stylistic, or aesthetic variations may occur, including but not limited to:
a) subtle illustrative or visual differences;
b) minor layout, formatting, or alignment variations;
c) small linguistic or stylistic differences inherent to creative content.
Such minor variations are a natural characteristic of personalized, individually generated creative products and do not constitute a defect.
MIBOOKO retains full responsibility for the production process and overall quality of its products.
10.5 Errors, Defects, and Technical Issues
If a MIBOOKO product:
a) contains a material technical defect;
b) includes incorrect personalization caused by a system or processing error;
c) cannot be accessed, downloaded, opened, or used as intended,
the customer is entitled to correction, replacement, or technical assistance, provided at no additional cost.
Each case will be assessed individually, and MIBOOKO will take appropriate corrective action in a reasonable timeframe.
This section does not limit or exclude any statutory consumer rights granted under applicable law.

10.6 100% Smile Guarantee (Voluntary Policy for Digital eBooks)
10.6.1 Voluntary nature.
MIBOOKO voluntarily offers a customer satisfaction guarantee called the “100% Smile Guarantee” for personalized digital eBooks delivered in PDF and EPUB formats (“Digital eBooks”). This guarantee is provided in addition to statutory consumer rights and does not limit any rights that cannot be excluded under applicable law.
10.6.2 Scope.
The 100% Smile Guarantee applies only to:
- Digital eBooks (PDF + EPUB) purchased on mibooko.com.
The 100% Smile Guarantee does not apply to:
- personalized audiobooks (including standard or parent voiceover);
- personalized printed books (softcover/hardcover);
- any third-party purchases, resales, or non-authorized distribution.
10.6.3 How to request.
To request a refund under the 100% Smile Guarantee, the customer must contact MIBOOKO within 7 days of purchase by replying to the order confirmation email with the subject line or first line: “REFUND”. The customer may optionally include a short description of what did not meet expectations to help improve our service.
10.6.4 Refund processing time.
If the request is approved under this policy, MIBOOKO will process the refund within 2 working days. Refunds are issued to the original payment method. Timing for funds to appear may vary depending on the customer’s payment provider or bank.
10.6.5 Refund amount.
If approved, the refund covers the price paid for the Digital eBook. Where applicable, refunds include the corresponding taxes/fees charged on the Digital eBook purchase (if collected by MIBOOKO as part of the order).
10.6.6 Fair use / abuse prevention.
This policy is intended to protect families and support confidence in ordering personalized content. MIBOOKO may refuse or limit requests, or restrict future purchases, if there is evidence of repeated or abusive refund behavior, fraud, chargeback abuse, or bad-faith use of the policy.
10.6.7 Relationship to statutory withdrawal rules.
Customers acknowledge that the statutory right of withdrawal may not apply to personalized digital content once generation has started and/or the final files have been delivered (Section 10.2). The 100% Smile Guarantee is a separate voluntary policy offered by MIBOOKO and may be used within the terms described above.
11. Warranties and liability
Nothing in this section will limit or exclude any warranty implied by law that it would be unlawful to limit or to exclude. This website and all content on the website are provided on an “as is” and “as available” basis and may include inaccuracies or typographical errors. We expressly disclaim all warranties of any kind, whether express or implied, as to the availability, accuracy, or completeness of the Content. We make no warranty that:
- this website or our products or services will meet your requirements;
- this website will be available on an uninterrupted, timely, secure, or error-free basis;
- the quality of any product or service purchased or obtained by you through this website will meet your expectations.

Except for obligations to pay money hereunder, no delay, failure or omission by either party to carry out or observe any of its obligations hereunder will be deemed to be a breach of these Terms and conditions if and for as long as such delay, failure or omission arises from any cause beyond the reasonable control of that party.

You agree to indemnify, defend and hold us harmless, from and against any and all claims, liabilities, damages, losses and expenses, relating to your violation of these Terms and conditions, and applicable laws, including intellectual property rights and privacy rights. You will promptly reimburse us for our damages, losses, costs and expenses relating to or arising out of such claims.

Failure to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision.

These Terms and Conditions will be interpreted and construed exclusively in English. All notices and correspondence will be written exclusively in that language.
22. Entire agreement
These Terms and Conditions, together with our privacy statement and cookie policy, constitute the entire agreement between you and MIBOOKO Sp. z o.o. in relation to your use of this website.
22.1 Service Updates & Post-Migration Improvements
Mibooko currently operates on an upgraded version of our story-generation and delivery platform. During this post-migration improvement period, minor visual, technical, or performance irregularities may occur. These do not affect the customer’s right to receive the purchased digital product. We continuously monitor and address any issues to ensure stable and secure operation.
23. Updating of these Terms and conditions
We may update these Terms and Conditions from time to time. It is your obligation to periodically check these Terms and Conditions for changes or updates. The date provided at the beginning of these Terms and Conditions is the latest revision date. Changes to these Terms and Conditions will become effective upon such changes being posted to this website. Your continued use of this website following the posting of changes or updates will be considered notice of your acceptance to abide by and be bound by these Terms and Conditions.
24. Choice of Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of Poland. Any disputes relating to these Terms and Conditions shall be subject to the jurisdiction of the courts of Poland. If any part or provision of these Terms and Conditions is found by a court or other authority to be invalid and/or unenforceable under applicable law, such part or provision will be modified, deleted and/or enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions. The other provisions will not be affected.
